Are There Title Restrictions on VA Loans?

Borrowers exploring their options with the VA loan program will learn that the Department of Veterans Affairs will not guaranty loans that restrict the borrower's ability to sell or dispose of the property. Any condo, duplex, or other community-property arrangement must not have bylaws or association agreements that would prevent the VA borrower from freely selling that property.

Some condo projects have a clause in their association paperwork or other agreements, known as the "right of first refusal." This clause can be trouble for those who want to get a condo project on the VA approved list. However, there are some cases where something may be viewed as a title restriction that may not necessarily interfere with the VA loan process.

According to Chapter Nine of VA Pamphlet 26-7, "VA may guarantee a loan on which a title restriction limits the sale, lease, or occupancy of the dwelling to persons based on age, including a prohibition against the permanent occupancy of the dwelling by children, provided such restriction complies with applicable Federal law." The last portion of that sentence is key.

Also, "VA may refuse to approve a property with an age restriction if its operation would work an undue hardship upon the owner in the case of sudden, unforeseen events or be likely to result in an increased risk of loan default."

Chapter Nine also mentions that title restrictions may not even require VA approval depending on what those restrictions might be. "Title to property involving reasonable encroachments, easements, servitude, and reservations for water, timber, or subsurface rights, generally do not require VA approval. However, they must be taken into consideration in determining reasonable value."

Such restrictions may require additional review by the Department of Veterans Affairs. "If any of these restrictions impact the basic livability of the property, VA approval is required."

And also, "Title conditions or limitations must be shown on the NOV and considered by the appraiser in determining the reasonable value of the property. If the lender discovers, prior to loan closing, title conditions or limitations not shown on the NOV, the lender must have VA review the conditions and determine whether the value assigned to the property is materially affected."

Fundamental mortgage Q&A: "How does refinancing work?"

When you refinance your mortgage, you are essentially trading in your old loan for a fresh one with a new interest rate and term. And possibly even a new balance.

You may elect to receive a new mortgage from the same bank that held your old loan previously, or refinance your loan with an entirely different lender.

It's certainly worth your while to shop around if you're thinking about refinancing, as your current lender may not have the best deal.

Regardless, the bank or mortgage lender that grants you the new mortgage essentially pays off your old mortgage with a new mortgage, thus the term refinancing.

In a nutshell, most borrowers choose to refinance their mortgage either to take advantage of lower interest rates or to cash in on equity accrued in the home.

Two Main Types of Refinancing

There are two main types of refinancing; rate and term refinancing and cash-out refinancing (click the links to get in-depth explanations of both).

Rate and Term Refinancing

Original mortgage: $300,000 loan, 30-year fixed @6.25%
New mortgage: $300,000 loan, 15-year fixed @4.50%

To put it simply, a rate and term refinance is basically the act of trading in your old mortgage(s) for a new shiny one without raising the loan amount.

In my example above, the refinancing results in a shorter-term mortgage with a lower interest rate. Two birds, one stone. It will be paid off faster and with less interest. Magic.

Reasons for carrying out this type of refinancing include securing a lower interest rate, moving out of anadjustable-rate mortgage into a fixed-rate mortgage (or vice versa), going from an FHA loan to a conventional loan, or consolidating multiple loans into one. And in our example, to reduce the term as well (if desired).

Lately, a large number of homeowners have been going the rate and term refi route to take advantage of the unprecedented record low mortgage rates available. They've been able to refinance into shorter-term loans like the 15-year fixed mortgage without seeing much of a monthly payment increase thanks to the sizable rate improvement.

Obviously, it has to make sense to the borrower to execute this type of transaction, as you won't be getting any cash in your pocket (directly) for doing it, but you will pay closing costs and other fees that must be considered.

So be sure to find your break-even point before deciding to refinance your current mortgage rate. This is essentially when the refinancing costs are "recouped" via the lower monthly mortgage payment.

If you don't plan on staying in the home/mortgage for the long-haul, you could be throwing away money, even if the interest rate is significantly lower.

    New applicants must have a $20,000 surety bond, using the correct form (one covers employees only, one covers employees and Independent Contractors)

    The company must register with the Washington Secretary of State and Business License Services
  • Trust Accounting
    The company must determine whether or not it must maintain a trust account and complete the correct form
  • Designated Broker
    The company must appoint a Designated Broker who meets the experience and testing requirements
  • Fingerprints
    Have each control person in the company get fingerprinted, unless the control person already holds a MLO license in Washington
  • Mortgage Broker Application- Cost $1,001 (including $100 NMLS System Fee)
    Complete and submit through the NMLS a Mortgage Broker Application (Form MU1 and attached MU2 for control people)

Steps to Apply for a Washington Mortgage Broker License

  1. Gather all items listed on the New Application Checklist
    If you do not have the items listed on the application checklist before applying, the processing of your application will be delayed and you risk your application being abandoned.
  2. Apply for Washington Mortgage Broker License Through the NMLS
    Complete and submit your application through the NMLS (link is external), including paying the licensing fee. You should also submit sponsorship requests for any MLOs who will be working in Washington at the same time. Additionally, if you are going to apply for branch licenses, you should also apply for those at the same time.
  3. Within 5 business days of applying for a Washington Mortgage Broker License, you must:
